Quote of the day - Steven Pinker (April 3, 1994)

I found this during a "Wiki-Wander" a while back, starting at a post at Weer'd's place, through a few Wikipedia entries, and ending up at a New York Times Op-Ed piece from April 3, 1994, written by Harvard psychology/cognition/linguistics professor Steven Pinker, entitled "The Game of the Name" (PDF warning).

This will actually be a two-fer Quote of the Day because there's some context required. First, we need to describe a concept Mr. Pinker calls the "euphemism treadmill":
People invent new "polite" words to refer to emotionally laden or distasteful things, but the euphemism becomes tainted by association and the new one that must be found acquires its own negative connotations.
To sum up, a politically-correct and -neutral term becomes emotionally charged -- and therefore offensive -- and so it must be replaced by a new politically-correct and -neutral term. As an example, Mr. Pinker offers the word "slum," which was replaced by "ghetto," which was in turn replaced by "inner city," and has since reverted back to "slum" (presumably because "slum" has "healed" from its negative connotations).

Now that that's out of the way, we get to the real Quote of the Day:
The euphemism treadmill shows that concepts, not words, are in charge: give a concept a new name, and the name becomes colored by the concept; the concept does not become freshened by the name.
So, what does all this psycho-babble have to do with a gun blog, you ask?

Two words: "Gun Safety".

I'll leave the inferences and conclusions to you, dear readers. Feel free to sound off in the comments; I have some additional thoughts, but I'd like to know what you all think.

9/11 Prep

This Thursday is the 13th anniversary of the 9/11 attack on the World Trade Center.

Because of the newly invigorated Islamists, our feckless defense and foreign policy, the deliberately compromised immigration system and the wide open southern border, this is probably the most dangerous 9/11 anniversary to date. Unfortunately, the danger will probably ratchet up each year for the foreseeable future.

In any case, it's probably a good time to review your everyday disaster preparations.
  • Always keep no less than a half of tank in the cars and trucks
  • Have at the very least one week's worth of water, food and supplies
  • Be able to live "off the grid" (light, heat, cooking, sanitation, etc) for a week
  • Money talks; be prepared to shout with physical cash
  • Get a good first-aid kit: more than the cheapy band-aids and aspirin kits
  • Have a good toolset: standard tools, plus prybars, axes, util. knives and guns
  • Prepare your bug out bag, or as we call them: Go Boxes (3 Rubbermaid boxes)
  • Lock your house and car doors
  • Keep your head on a swivel
That's the minimum: many experts are recommending at least 3 weeks of capability.
  • Most importantly: exercise, get in shape, lose weight, and quit smoking -- a heart attack is by far the most probable killer you will face

As I tell the wife when she accuses me yet again of paranoia: "Yes, I'm paranoid -- But, am I paranoid enough?"

A  mob of 20-50 youths (reported elsewhere as upwards of 100-120) randomly attacked a Kroger shopper and two Kroger employees who came to his aid. Cell phone video showed one employee being repeatedly kicked the head. The mob was shouting "Fam Mob" (a local street gang) and apparently chose their victims based on race. One witness described the attack as being a game; the "Point 'em out - Knock 'em out" game. A felonious "game" that has already turned deadly. 

There have been no arrests to date. Fortunately, the three victims are recovering. Given the number of assailants and the viciousness of the attacks, it could have been much, much worse. However, there is absolutely no guarantee the next "game" won't result in a greater tragedy.

Update: A 15 year old thought to be the assailant in bright green stomping and kicking the store employee's head has been arrested.


Mad  Moms, tell us again why we should be disarmed while shopping at Kroger.

A little advice: you need to avoid urban malls, parks, concerts, sporting events and other places large groups of youths gather. Keep your head on a swivel -- It's getting more dangerous out there.

Note: YouTube has removed the original unedited video of the attack first used in this post.  A screen explains the "The video has been removed as a violation of YouTube's policy of prohibiting content designed to harass, bully, or threaten." This is a highly questionable excuse, as the video only shows the actual attack with unrestrained comments from the cell phone operator. Why this censorship? One is left wondering if this video is too revealing for YouTube and their owner Google's political sensitivities. 

I've replaced the original clip with another one. However, given Google/YouTube's past actions, it might also disappear.

Moms Demand Action - But Not Truth

Moms usually demand the truth, especially when looking over a broken lamp at a snot-nosed brat. (I speak from experience.) That doesn't seem to be the case with Bloombergs's astroturfing Moms Demand Action for Gun Sense in America. Shannon Watts, founder of the shrewish ant-gun org, has told a whopper, and few seem interested in calling her on it.

CNN's Victor Blackwell's convoluted, artificially constrained question asked Watts “Is there an example in school shootings or a mall shooting or these public facilities, where that has been wrong? Where a bad guy with a gun has been stopped in any other way or by a person other than a law enforcement officer with a gun or by killing himself?” MDAG's Watts replied “This has never happened. Data shows it doesn’t happen.”

Even without Google Assisted Memory, I can think of quite a few instances where a good guy (or gal) with a gun has stopped a mass killing. Those in schools, churches, shopping malls,theaters, etc. have benefited many times from an armed citizen's actions. Anecdotal evidence even suggests that the mere possibility of a CCW being present caused a spree killer to specifically chose a theater disarmed by a gun-free sign. To answer with an absolute "Never"... Well, Watts was either wildly incorrect or she deliberately misspoke - i.e. lied.

It wouldn't be the first time.

We often justly damn the gun control industry for their emotion laden misrepresentation of the facts. They're so welded to their position that they're compelled to make the most outrageous lies. Winning at all costs, by any means is their goal; as (wait for it) the ends justify the means. It should come to no ones surprise that Shannon Watts is herself a disingenuous construct. Thanks to Miggy's (Gun Free Zone blog) work, we find that Watts is also known as Shannon Troughton, a high-powered executive with extensive experience as a professional shill; excuse me: corporate communications and political public affairs officer. In the 1st Freedom Sep 14 issue article; Not Watts She Seems, the NRA also examines the the false front that is Shannon Watts. She's hardly the carefully crafted stay-at home mom portrayed in the media. In that context, a finely nuanced, bald face lie in support of Bloomberg's anti-gun agenda can certainly be expected.   

It is important that we do not sink to the level of our foes. Watts/Troughton has been given a free pass - we would not. In any case, we should not want to be like them.

BREAKING: Dangerous Decision from the California Supreme Court

Just last month, the California Supreme Court issued an opinion that could cause serious problems for anyone who might find themselves involved in an incident where criminal charges are a possibility. [...]  
This particular case revolved around a negligent vehicular homicide charge. However, the ruling has serious implications for every citizen, especially those of us who carry, because in “California v. Richard Tom” (08/14/2014), the court has essentially turned the Fifth Amendment on its head.

IANAL, but scanning through the decision, it quotes heavily from prior cases (not surprising in itself), but one U.S. Supreme Court case in particular stands out: Salinas v. Texas (2013), which found that before the reading of Miranda rights, if the person being questioned wants to invoke his/her Fifth Amendment rights, he/she must clearly and unambiguously say so. Simply "clamming up" can and will be used against him/her, sometimes just as effectively as saying too much.

Now, given the extent that this case relies on U.S. Supreme Court precedent, I think it's highly unlikely it will prevail on appeal, if it even is appealed, but that's pure speculation on my part.

Where the rubber meets the road, though, is this: "Sure, it's a crappy decision, but so was Salinas. What's it mean for us in the real world?"

Here's my take (worth every penny you're paying for it): In "Verdict in Detroit 'Front Porch' Shooting", I gave four pieces of personal advice (not to be confused with "legal advice"; consult a qualified defense attorney for that) if you're involved in a lethal-force encounter, including this:
Don't talk to the police. At least, don't talk to the responding police until after you've had a chance to talk with your attorney. Be polite, cooperate, but don't make statements; they can and will be used against you -- just like the Miranda rights say, whether or not the police have read them to you -- so don't give them an opening. Just say, "I will cooperate, and I'm more than willing to provide a statement, but I'm still frazzled and I'd like to wait until I can calm down and consult with my attorney." They'll want an immediate statement, but there's no law compelling you to provide one. Better to wait until you've had a chance to process the events, to compose yourself, and to discuss with competent defense counsel what you should say.
With this new decision in California v. Richard Tom, plus the previous one in Salinas v. Texas, the act of clearly and unambiguously stating that you're invoking your right to remain silent (for now) is more important than ever. They're going by a "reasonable police officer" test (from Davis v. United States [1994], if you're interested) -- presumably sort of a "reasonable man" test, applicable to police officers -- so make sure your statement to remain silent until counsel is present would be clear to a "reasonable cop".

Also, because the case rose out of the fact that Richard Tom didn't ask about the condition of the people in the other car, which became part of the prosecution's "consciousness of guilt" argument, it wouldn't hurt to follow up your statement by asking how the other party is doing.

Bloomberg/Watts' Revenge - Kroger in the News Again

Some time back, we reported that Kroger opted not to bow to pressure from Shannon Watts' and
Michael Bloomberg's gun control group, Everytown for Gun Safety, to ban the peaceable carrying of firearms in their stores. Kroger's perfectly reasonable statement (emphasis added):
The safety of our customers and associates is one of our most important company values. Millions of customers are present in our busy grocery stores every day and we don’t want to put our associates in a position of having to confront a customer who is legally carrying a gun. That is why our long-standing policy on this issue is to follow state and local laws and to ask customers to be respectful of others while shopping. We know that our customers are passionate on both sides of this issue and we trust them to be responsible in our stores.
 Like I said: perfectly reasonable. Law-abiding folks will abide by laws, responsible folks will conduct themselves responsibly, and respectful folks will respect others. In other news, water is wet (ZOMG, insert dramatic "Dun dun DUUUUNNNN!!" sound here).

Naturally, though, when dealing with megalomaniacal billionaires (like Bloomberg) and control-freak busy-bodies (like Watts), you just knew this wouldn't go over well.

And so it hasn't. Forbes reports (emphasis added):
Michael Bloomberg-backed gun control group Moms Demand Action for Gun Sense in America launched its first ever large-scale corporate campaign on Thursday with an advertising spend of six figures aimed at pressuring Kroger, the country’s biggest grocery chain, to change its firearms policies.
Yep. A six-figure advertising campaign against Kroger, for the audacity of telling Hizzonner to shove it where to go and what to do there to leave them alone and let them make their own decisions on what will and will not be allowed at their own properties.

The ads themselves are pretty pitiful, too, following a pattern familiar to those of us who remember Moms Demand Attention Action's previous campaign against carrying in schools:
Seriously, I wouldn't want to see that in the store, either.

So again, I'm asking that we, collectively, throw Kroger some business and thank them for upholding the rule of law, and our rights. They did right by us - even it if was just refusing to get caught in the middle - so we need to do right by them.

Deputy Brandon Love's Status

I'm happy to report that LA County Sheriff's Deputy Brandon Love is doing better than expected. He is out of the hospital, in a rehabilitation facility, and yesterday - he took four steps. Those few, once simple steps are his first since being assaulted and critically injured by an unarmed man on Aug 15, 14: Michael Brown and Deputy Brandon Love. 

Hopefully, those steps are the first on his way to a complete recovery. However, there is no doubt that the road will be long, steep, and painful.

Brandon, you remain in our thoughts and prayers.

10 Onerous - But Legally Vulnerable - Gun Laws

Professor Eugene Volokh, writing in the Washington Post, has a very interesting article: The 10 most practically significant — yet potentially legally vulnerable — restrictions on availability of guns for self-defense

 The good Professor, a well respected Constitutional scholar and blogger at The Volokh Conspiracy, lists ten areas of gun laws that significantly restrict the Right to Self Defense - yet may be susceptible to the ongoing wave of pro-rights litigation. He admits the list is only an initial look, but it seems a damn good one - with one exception noted below.

Summarized:  the 10 potential liberation areas are: Carrying a gun in public places; Handgun ownership by 18-20 year olds (if they can vote...); Gun possession and carrying by legal aliens; Gun possession in Gov't housing including dorms, recovering of rights by minor felons and mental health holds for those that have served there time, been cured, or the issue were significantly period ago without other infractions; and finally, the onerous Legal fees charged for exercising self-defense rights.  

 I wonder what Alan Gottlieb of the Second Amendment Foundation's list looks like...

I am a little concerned that Volokh specifically mentions bans on "assault weapons " as being outside his tests for substantially interfering with self-defense and legally vulnerable. As many have pointed out before, the Modern Sporting Rifle is functionally the same as the slightly more Hippie-friendly semi-automatic traditional pattern rifles. The recent riots have shown just how suitable that aggregation of stocks. pistol grips, box magazines and shoulder things that go up is for self-defense. Excluding the MSR makes no sense.
